This Privacy Policy is intended to describe how Kadogo handles information that you provide, or that we learn about the individuals who: visit or use any of our websites (the “Site”), access or use our mobile app or services, contact us by mail, email or telephone or in person, or who provide us with information through any other means. We recommend that you carefully review this notice before providing us with any information. For purposes of this Privacy Policy, the Site and our mobile app and services shall be collectively referred to as the “Services.”

BY VISITING OR USING THE SERVICES, YOU EXPRESSLY CONSENT TO THE PROCESSING OF YOUR PERSONAL INFORMATION ACCORDING TO THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, YOUR CHOICE IS TO NOT USE THE SERVICES. YOUR PERSONAL INFORMATION WILL BE RETAINED IN THE UNITED STATES AND THE LAWS IN THE UNITED STATES REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.

IF YOU ARE USING THE SERVICES AS A BUSINESS OR NON-PROFIT, ANY PUBLIC INFORMATION ABOUT YOUR ORGANIZATION OR YOUR FUNDRAISING EVENT THAT YOU UPLOAD TO THE SERVICES WILL BE AVAILABLE GENERALLY TO ALL USERS OF THE SERVICES. IN ADDITION, USERS OF OUR SERVICES MAY HAVE THE ABILITY TO SEARCH THE SERVICES FOR PARTICIPATING BUSINESSES AND NON-PROFITS AND TO DIRECT MESSAGE THE ACCOUNTS ASSOCIATED WITH THOSE BUSINESSES AND NON-PROFITS. YOU CAN REVIEW YOUR ACCOUNT SETTINGS TO UNDERSTAND WHICH COMPONENTS OF YOUR PROFILE WILL BE PUBLICLY AVAILABLE. 

  1. Scope

This Privacy Policy applies to personal information that Kadogo receives during its business operations as a “data controller” – which means Kadogo determines the purpose and means of processing such personal information. For purposes of this Privacy Policy, the term “personal information” means any information that, alone or in conjunction with other information or data, identifies or is linked to a particular individual, household, or device and that is subject to, or otherwise afforded protection under, a data protection law, statute, or regulation. The term “personal information” does not include anonymized or de-identified data that is not attributable to a particular individual, household, or device and that is not otherwise subject to a data protection law, statute, or regulation. Kadogo may anonymize or de-identify personal information, and such data is not subject to this Privacy Policy, and Kadogo may use such data for any lawful, business purpose.

  1. The Types and Categories of Personal Information We Collect

Kadogo collects personal information in order to provide our Services, comply with our legal obligations, promote our business interests, and for the other reasons set forth in this Privacy Policy. When you do not provide personal information to Kadogo, we may not be able to provide you the Services or to complete a transaction you requested. Generally, we collect the following types and categories of personal information during our business operations:

Marketing and Communications Data Information with respect to your marketing preferences and your subscriptions to our publications and alerts.
Internet and Electronic Network Data Data pertaining to your access or use of the Services, including browsing history, search history, and information regarding your interaction with the Services or advertisements embedded on the Services or other third-party websites.
Your Feedback Information you provide about our Services, which may include data gathered from any Kadogo surveys or reviews submitted by you.
Geolocation Data Information about the general city, state, or region in which a user of our Services is located.
Professional or Employment Data (For more information, see “Employment Applications and Talent Management” below) If you apply for a job with Kadogo, we collect information set forth in a resumé, curriculum vitae, cover letter, and similar documentation, including contact details, employment history, skills, or qualifications, education-level, job compensation and benefit preferences, criminal record, credit history and similar data, and information provided about or by your references.
Inferences Inferences drawn from some of the personal information categories identified herein and used to create a consumer profile reflecting your purchasing and marketing preferences, characteristics, and behavior.

Technical Data

When you access the Services, we collect certain data automatically using technical means and tools. This data relates to your device, and your experience on the Services and other websites, including the following:

Usage and Device Data. When you access and use the Services, we automatically collect details of your access to and use of the Services, including traffic data, usage logs and other communication data, and the resources that you access and use on or through the Services (e.g., browsing history, search history). We may also collect information about your device and internet connection, including the device’s unique identifier (e.g., device type, IMEI, Wi-Fi MAC, IP address), operating system, browser type, and mobile network information. The Services may collect “diagnostic” data related to your use of the Services, such as crash data and logs, performance data (e.g., launch time, hang rate, or energy use), and any other data collected for the purposes of measuring technical diagnostics.

Cookies and Tracking Data. We use “cookies” and other tracking technologies within the Services. A cookie is a small file placed on your smartphone or other device. It may be possible to refuse to accept cookies by activating the appropriate setting on your smartphone or device. However, if you select this setting, some parts of the Services may become inaccessible or not function properly. In addition, the Services may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to analyze data on your use of the Services (e.g., recording the popularity of certain content and verifying system and server integrity). The Services may collect data about the advertisements you have seen or engaged. For more information, see Section 20 (Cookies and Analytical Tools).

  1. Transaction and Payment Card Data

If you are using the Kadogo Rewards features of the Services, and you enroll an eligible card (“Enrolled Card”) or use the Enrolled Card at a participating merchant, Kadogo or its service providers, such as Fidel, will be collecting your Enrolled Card identifier, merchant location, transaction date/time and amount (“Transaction Data”). If at any time, you want to remove an Enrolled Card from the App, you may do so in your account settings. As soon as a card is no longer linked in the Kadogo App, Kadogo will stop collecting any Transaction Data. You are free to decide whether to enroll an eligible card on the Kadogo App, however, if you do not do so, you will not be eligible to earn cashback rewards under the Kadogo Rewards program. By registering a payment card in connection with transaction monitoring, you authorize Kadogo and Fidel to share your payment card information with Visa, Mastercard and AMEX (Payment Networks) so it knows you enrolled. You authorize Mastercard and Visa to monitor transactions on your Enrolled Card to identify qualifying purchases in order to determine whether you have qualified for or earned an offer linked to your payment card, and for Visa, Mastercard and AMEX (Payment Networks) to share such transaction details with Kadogo to enable your card-linked offer(s) and target offers that may be of interest to you. You may opt-out of transaction monitoring on the payment card(s) you have registered by navigating to your settings menu to remove your linked card(s). 

Notwithstanding anything to the contrary in the Terms or Privacy Policy, Kadogo and its third party service providers (including, without limitation, Fidel) will use Transaction Data solely as follows: (i) to determine whether a purchase or return made with your Enrolled Card qualifies to earn a reward (“Qualified Purchase”); (ii) to confirm a transaction with a participating merchant; (iii) to anonymize or aggregate information related to Enrolled Card activity to assess the results

of a campaign; (iv) to create a record of Transaction Data as needed to facilitate administration of the Kadogo Rewards program; and (v) to protect the rights of Kadogo, a merchant, a service provider or a third party related to an inquiry from a government authority or payment organization. 

Kadogo uses Plaid to process your payments if you use the Services to make a purchase and to verify qualifying purchases at a fundraising event. Your payment information is subject to the privacy policy and terms of use of Plaid. We recommend you review these policies before uploading any credit card or other financial information to Plaid. Kadogo does not have access to your credit card information and does not store this information on our servers. Kadogo can view information regarding the purchases you made during a fundraising event, including without limitation, any items purchased, date, time and location of transaction and purchase price, and may share this information in an anonymized form with a Business or Non-Profit. 

  1. Public Posting 

You may also choose to post, upload or disseminate through push notification, additional information, such as videos, photos, comments, reviews or other content (“User Content”) to publicly available portions of the Services. User Content you post on a public forum or make publicly available will be available to other users of the Website and may be retrievable by third-party search engines. Third parties may also be able to download or share your User Content to social media sites such as Facebook, Pinterest, Twitter, Google+ as well as via email. We recommend that you guard your privacy and anonymity and not upload any User Content that you are not comfortable being available to the general public. Any third party with access to your information via the Services will be permitted to use the information in the same manner as if you submitted the information directly to that third party. Publicly posting any information on the Services is entirely voluntary on your part and we recommend you carefully consider the information you choose to make publicly available. You are responsible for your User Content and any consequences thereof. 

  1. Sources of Information

We collect the personal information identified herein directly from you when you use our Services, through automated means, and from third parties. More specifically, we collect personal information from the following sources:

First Party / Direct Collection. We collect personal information directly from you when you use our Services (e.g., account registration, completing purchases, signing-up for subscriptions), when you provide us feedback on our Services or whenever you directly engage with us, such as when you visit our offices or premises or otherwise contact us.

Automated Collection. As described above, we may collect information and data, such as usage data and cookies, through automated means when you use the Services (see “Technical Data” above).

Third-Party Sources. We collect personal information from third parties, such as publicly available databases, social networking providers, advertising companies, our service providers, and third-party references.

  1. How We Use Your Personal Information / Purpose of Collection

We use the personal information we collect to provide you full access and functionality of the Services. Accordingly, your information may be used for the following purposes: (i) to provide and improve our Services, features and content; (ii) to administer your use of our Services and accounts; (iii) to enable users to enjoy and easily navigate the Services; (iv) to better understand your needs and interests; (v) to fulfill requests or to respond to questions or comments you may make; (vi) to personalize your experience; (vii) to provide you with announcements, notifications and advertisements related to your interests and use of the Services and other communications such as electronic newsletters, promotional e-mails or similar messaging; (viii) to provide announcements about our Services or your account; (ix) to protect and safeguard the Services; (x) to assess the level of general interest in the Services and (xi) for any other purpose with your consent.

  1. Sharing Information / Third Party Disclosures

We may share your personal information with certain organizations and third parties in accordance with applicable law, including as set out below. However, we do not share personal information with third parties that we have reason to believe use such information for their own direct marketing purposes.

Service Providers. We may share your personal information with companies that provide services on our behalf, such as hosting and analyzing the Site, conducting surveys and marketing on our behalf, processing transactions, tracking and responding to questions or complaints, and performing analyses to improve the quality of our Services.

Payment Card Transactions. All payments for purchases made through the Site are completed using a third-party vendor’s online payment system. Kadogo does not have access to your credit card information and does not store or disclose your full credit card information. Any personal or financial information you provide to our online payment system is subject to the third party’s privacy policy and terms of use, and we recommend you review these policies before providing any personal or financial information. For more information, see Section 3 (Transaction and Payment Card Data).

Distributors and Business Partners. We may share your personal information with third parties that distribute our goods, products, and marketing materials.

Business Restructuring. Circumstances may arise where for strategic or other business reasons Kadogo decides to sell, buy, divest, merge or otherwise reorganize our businesses. We may disclose your personal information to the extent reasonably necessary to proceed with the negotiation or with the completion of a merger, acquisition, divestiture or sale of all or a portion of Kadogo’s assets.

Legal and Business Interests. We may disclose personal information (i) if required by law or government order, or with a legal process, (ii) to protect and defend our rights or property, or (iii) in urgent circumstances, to protect the health and personal safety of any individual. In addition, Kadogo may disclose your personal information with any third party when we believe such disclosure is necessary to defend or protect our legal, regulatory, or business interests. 

Consent. We may also disclose your information upon your express consent and in accordance with the other terms and conditions with respect to personal information sharing and disclosure as set forth herein.

In the event that you facilitate a transaction with Kadogo, or request information from or otherwise engage with us, and such activities require Kadogo to share your personal information with a service provider or other third party, you hereby consent to such disclosure and/or direct Kadogo to intentionally disclose your personal information to the service provider or third party.

  1. Social Media

We may engage with you on various social media platforms (e.g., Facebook, Twitter, Pinterest, Instagram). If you contact us on a social media platform for customer support or for other reasons, we may contact you via the social media’s direct message tools. Those communications to and from us are governed by this Privacy Policy. However, your use of a social media platform is also subject to the policies and terms of the relevant social media platform. Certain social media platforms may also automatically provide us with your personal information, the information we receive will depend on the terms that govern your use of the social media platform(s) and any privacy settings you may have set.

  1. Children’s Privacy

The Kadogo website and Services are not intended for children under the age of 16 and Kadogo does not knowingly collect any information from children under 16 years old through its Site. If the parent or guardian of a child under 16 believes that the child has provided us with any information, the parent or guardian of that child should contact us if they want this information deleted from our files. Children under 16 years of age may not use our Services. 

  1. Security

We are committed to protecting your personal information. We regularly test our facilities and use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. HOWEVER, NO INFORMATION SYSTEM CAN BE FULLY SECURE AND WE CANNOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR PERSONAL INFORMATION. MOREOVER, WE ARE NOT RESPONSIBLE FOR THE SECURITY OF PERSONAL INFORMATION YOU TRANSMIT TO THE SITE AND/OR THE SERVICES OVER NETWORKS THAT WE DO NOT CONTROL, INCLUDING THE INTERNET AND WIRELESS NETWORKS, AND YOU PROVIDE US WITH ANY PERSONAL INFORMATION AND DATA AT YOUR OWN RISK. TO THE EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE OR OTHERWISE RESPONSIBLE FOR ANY DATA INCIDENT OR EVENT THAT MAY COMPROMISE THE CONFIDENTIALITY, INTEGRITY, OR SECURITY OF YOUR PERSONAL INFORMATION CAUSED BY A THIRD PARTY. The safety and security of your personal information also depends on you. Where we have given you (or where you have chosen) a username and password to access our Services, you are responsible for maintaining the security and confidentiality of those credentials and not revealing them to others. You must contact us immediately if you have reason to believe that your username or password to our Services has been compromised. You acknowledge and agree that we may contact you via email or other electronic communications in the event we are legally required to notify you of a data security incident or event related to your personal information

  1. We Do Not Sell Your Personal Information

Kadogo does not, to the best of our knowledge, sell, rent, or license personal information that we have collected or retain about you to any other third-party for profit or any monetary or other valuable consideration. Accordingly, we do not offer individuals the ability to “opt-out” of the selling or renting of personal information because we do not engage in those practices. 

  1. Our Data Retention Criteria

The period during which we store your personal information varies depending on the purpose for the processing. For example, we store personal information needed to deliver our Services , or to facilitate transactions you have requested, and for so long as you are a customer of Kadogo. We store your personal information for marketing purposes until you have opted-out of receiving further direct marketing communications in accordance with applicable law. In all other cases, we store your personal information for as long as is needed to fulfill the purposes outlined in this Privacy Policy, following which time it is either anonymized (where permitted by applicable law), deleted or destroyed. 

  1. Your Rights and Responsibilities

You are permitted, and hereby agree, to only provide personal information to Kadogo if such personal information is accurate, reliable, and relevant to our relationship and only to the extent such disclosure will not violate any applicable data protection law, statute, or regulation or infringe upon a person’s data privacy rights or privileges. IF YOU PROVIDE PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO KADOGO, YOU EXPRESSLY REPRESENT AND WARRANT TO KADOGO THAT YOU HAVE THE FULL RIGHT AND AUTHORITY TO PROVIDE KADOGO WITH SUCH PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) AND THAT KADOGO’S USE AND PROCESSING OF SUCH PERSONAL INFORMATION AS SET FORTH HEREIN WILL NOT VIOLATE ANY PERSON’S RIGHTS OR PRIVILEGES, INCLUDING RIGHTS TO PRIVACY. YOU HEREBY AGREE TO FULLY AND COMPLETELY INDEMNIFY KADOGO FOR ANY CLAIMS, HARM, OR DAMAGES THAT MAY ARISE FROM YOUR PROVISION OF PERSONAL INFORMATION (INCLUDING PERSONAL INFORMATION CONCERNING A THIRD PARTY) TO KADOGO.

  1. Updating / Correcting Your Information

It is important that the personal information that you provide to us is accurate and reliable. In certain circumstances, you may have the ability to directly edit your account to update and change your personal information (e.g., name, telephone number, email) and you must do so, when such changes are warranted. If your account does not contain such features, then you must directly notify Kadogo of any changes or updates to your personal information in accordance with the “Contact Us” section listed below.

  1. Email Marketing and Your Rights

You have the right to opt-out of receiving email marketing communications from us. Generally, the email marketing communications that you receive from us will provide you an option to “unsubscribe” from receiving future email marketing communications from us. You may also unsubscribe from such email marketing by contacting us in accordance with the “Contact Us” section listed below. You hereby agree to immediately notify Kadogo, in writing, in the event you no longer own, license, or use an email address to which you subscribed to receive email marketing from us.

  1. Do Not Track

Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals. 

  1. California Privacy Rights

Data Privacy Rights. Pursuant to the California Consumer Privacy Act of 2018, as amended (“CCPA”), California residents have additional data privacy rights, including the following:

  • Right to Know: The right to know about what personal information Kadogo collects about you, and our intended use of, and purposes for collecting, your personal information. The personal information that we collect from you, the purposes for which it is used, the source of such personal information, and the parties to whom we share your personal information, among other issues, are set forth in this Privacy Policy (see above). 

  • Access: The right to access general categories and/or the specific pieces of personal information we have collected, used, disclosed, or sold about you over the past twelve (12) months, including the sources from which the personal information was collected; the business or commercial purpose for which your personal information was collected, used, disclosed, or sold; and, the third parties with whom we have shared your personal information.

  • Deletion/Erasure: The right to request that we delete/erase your personal information under certain circumstances.

  • Data Portability: The right to request that Kadogo transfers, to the extent technically feasible, personal information in certain forms and formats.

  • Nondiscrimination: The right not to be subject to discrimination for asserting your rights under the CCPA. 

To exercise any of the CCPA’s data privacy rights set forth herein, please contact us in accordance with the “Contact Us” section listed below. If you would prefer, you may designate an authorized agent to submit a CCPA privacy request on your behalf.  An authorized agent must be registered with the California Secretary of State to conduct business in California.

Privacy Request Verification Process. If you (or your authorized agent) makes any request related to your personal information under the CCPA, Kadogo will ascertain your identity (and the identity of the authorized agent, to the extent applicable) to the degree of certainty required or permitted under the law before addressing your request. Kadogo will, to the extent required or permitted by law, require you (or your authorized agent) to verify your request via email or other means and match at least two or three pieces of personal information we have previously collected from you before granting you access to, or erasing, specific pieces or categories of personal information, or otherwise responding to your request. We may require written documentation that demonstrates a third party is authorized to serve as your agent for the purposes of submitting the requests set forth herein, unless you have provided the authorized agent with power of attorney pursuant to California Probate Code §§ 4121 to 4130. None of the CCPA’s rights are absolute and are subject to legal and regulatory exceptions and exemptions. For more information about the CCPA, please see: https://oag.ca.gov/privacy/ccpa.

  1. Nevada Privacy Rights

Kadogo does not currently conduct “sales” of personal information for purposes of Nevada law. Notwithstanding the foregoing, Nevada residents may submit a request directing us to not sell personal information we maintain about them to third parties who will sell or license their information to others. If you would like to exercise this right, please contact us in accordance with the “Contact Us” section listed below.

  1. Links to Third-Party Websites

The Services may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services. 

  1. Our Use of Cookies and Analytical Tools

Cookies are text files containing small amounts of information which are downloaded to your hard disk or to your browser’s memory when you visit one of our Sites. Cookies are useful because they help arrange the content and layout of our Sites and allow us to recognize those computers or other devices that have been to our Sites before. Cookies do many different jobs, such as allowing our Sites to remember your preference settings and helping us to enhance the usability and performance of our Sites and your experience using them. Our Sites also may contain electronic images known as web beacons – sometimes called single-pixel gifs – that allow us to count the number of users who have visited specific pages. We may also include web beacons in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon. The type of cookie or similar technology that may be used on our Sites can be categorized as follows: Strictly Necessary, Performance, Functionality & Profile and Advertising. 

Strictly Necessary Cookies. These cookies are essential for basic functionalities of the Site, and they enable you to move around our Site and use their features, particularly in connection with information searches and order placement. Without these cookies, services you have asked for cannot be provided. These cookies do not gather information about you that could be used for marketing or remembering where you have been on the internet. For example, a login/ authentication cookie which allows and manages your login to the Site and identifies you after logging in for a single session, a session cookie which is required to carry out the data transmission and provide the Site to you, a security cookie that detects repeat failed login attempts or similar abuses of the Sites. These types of cookies are regularly stored only as long as required for their purpose.

Performance Cookies. These cookies collect information about how you use our Sites, for example which pages you go to most often and if you get any error messages from certain pages. These cookies collect information that is used to improve how our Sites work. Without these cookies we cannot learn how our Sites are performing and make relevant improvements that could better your browsing experience. Examples of performance cookies that our Sites use include cookies from Google and Adobe Analytics (see further discussion below). 

Functionality & Profile Cookies. These cookies allow our Sites to store information that you provide, such as preferences, and to store technical information useful for your interactions with our Sites. For instance, they remember your user ID and elements of your user profile. They also ensure that your experience using the Sites is relevant to you. They may also be used to provide services you have asked for such as watching a video or commenting on a blog. These cookies will not be used to track your browsing activity on other websites. Without these cookies, a website cannot remember choices you have previously made or personalize your browsing experience. For example, we use a cookie to store your language preferences, which allows us to present you with product search results in the correct language, and we use a cookie to store your choice about the appearance of the cookie information banner that we display on our Sites. This cookie will help us remember your choice about the appearance of the cookie information banner when you subsequently visit the same site where you made your choice about the banner and any other Kadogo sites with the same domain or the same top-level domain. 

Advertising Cookies and Similar Technologies. These cookies or similar technologies may be used to deliver advertisements that are more relevant to you and your interests. They may also be used to limit the times you see an advertisement as well as help to measure the effectiveness of the advertising campaign. These cookies may track your visits to other websites. Without these cookies or other technologies, online advertisements you encounter will be less relevant to you and your interests. 

Setting Your Cookie Preference. You can usually modify your browser settings to decline cookies and you can withdraw your consent at any time by modifying the settings of your browser to reject or disable cookies or by opting out of specific cookies through the opt-out options shared below. If you choose to decline cookies altogether, you may not be able to fully experience the features of the Sites that you visit. 

Our Use of Cookies and Analytics.We use different analytic tools which serve the purpose of measuring, analyzing and optimizing our marketing measures and provide you with customized advertisements that could be of particular interest to you. In particular, we use the following tools: 

Google Analytics uses cookies which enable an analysis of your use of the Sites. The information collected (IP address, browsing activities and other data linked to your usage of the Sites) is usually transferred to a Google server in the USA and stored there. You can prevent Google Analytics from recognizing you on return visits to the Sites by disabling cookies on your browser. Google Tag Manager helps to manage website tags through a single interface. The tool itself (implementing the tags) triggers other tags that may themselves collect (personal) data. However, Google Tag Manager does not access this data.
